Current law is clear that the assessment of whether the design of a highway is defective must be based on a comparison with the standards that were generally accepted at the time the highway was constructed or reconstructed. In the absence of generally accepted standards, comparison must be made with those design theories or criteria that were generally accepted at that time.
The scope of this publication is limited to textbooks and standards published during the time period of 1919 to 1945. From 1954 onward, the design policies of The American Association of Highway (and Transportation) Officials are the preeminent sources of highway design standards. Photocopy.
